Please read them carefully. They include important disclaimers and limitations of liability.
1. Acceptance Of These Terms
- These Terms of Service and Conditions govern your access to and use of Carinfo.AI, including our website, applications, tools, data, and related services.
- By creating an account, accessing, or using Carinfo.AI, you agree to these Terms. If you do not agree, do not use the service.
- If you use Carinfo.AI on behalf of a company, fund, partnership, or other organization, you represent that you have authority to bind that organization to these Terms.
2. The Service
- Carinfo.AI provides a private collector-car intelligence and underwriting workspace for organizing watched cars, market data, comparable sales, operator contacts, diligence notes, and related workflows.
- The service may include public vehicle data, auction listings, market references, government data, enrichment outputs, calculations, summaries, and other informational materials.
- We may add, change, suspend, or discontinue features at any time. We are not required to maintain any particular feature, source, integration, or data field indefinitely.
3. Accounts And Security
- You must provide accurate account information and keep it current.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You must notify us promptly if you believe your account has been compromised or used without authorization.
- We may suspend or terminate access if we believe an account is being used unlawfully, insecurely, abusively, or in violation of these Terms.
4. Permitted Use
- You may use Carinfo.AI only for lawful business, research, diligence, and personal collector-car evaluation purposes.
- You are responsible for your own investment, purchase, sale, tax, insurance, legal, and operational decisions.
- You must comply with all laws and third-party rights that apply to your use of the service and to any information you upload, store, or process through it.
5. Prohibited Use
- Do not use the service to violate laws, infringe rights, misappropriate data, harass others, commit fraud, or facilitate unsafe activity.
- Do not attempt to access another user's account, private workspace, or non-public data.
- Do not interfere with, probe, scan, overload, reverse engineer, scrape, bypass, or compromise the service or its security controls except as expressly authorized in writing by us.
- Do not upload malware, harmful code, unlawful material, or content you do not have the right to use.
- Do not resell, sublicense, or commercially redistribute the service or private outputs unless we agree in writing.
6. Your Content
- You retain ownership of the private notes, records, and other content you submit to your workspace, subject to the rights granted in these Terms.
- You grant Carinfo.AI a limited license to host, store, process, display, reproduce, and use your content only as needed to provide, secure, maintain, support, and improve the service.
- You represent that you have the rights needed to submit your content and that your content does not violate law or third-party rights.
- You are responsible for reviewing and backing up important content. We are not a system of record for legal, tax, insurance, title, purchase, or sale obligations.
7. Public And Third-Party Data
- Carinfo.AI may display data from public sources, third-party sources, government databases, listing sites, auction platforms, enrichment tools, or user-entered references.
- Third-party and public data may be incomplete, outdated, inaccurate, duplicated, delayed, mislabeled, unavailable, or subject to third-party terms.
- You are responsible for independently verifying vehicle identity, title, condition, provenance, mileage, ownership, liens, recall status, pricing, taxes, fees, and any other material facts before making a decision.
8. No Professional Advice
- Carinfo.AI is an informational and workflow tool. It does not provide legal, tax, accounting, investment, insurance, appraisal, mechanical, title, or financial advice.
- Scores, estimates, summaries, comparable sales, market data, and other outputs are not guarantees of value, authenticity, liquidity, safety, future performance, or investment outcome.
- You should consult qualified professionals and conduct independent diligence before buying, selling, financing, insuring, restoring, or investing in any vehicle.
9. AI And Automated Outputs
- The service may include automated, algorithmic, or AI-assisted features. These outputs can be incorrect, incomplete, or misleading.
- You are responsible for reviewing outputs before relying on them and for deciding whether they are appropriate for your use case.
- We do not guarantee that automated outputs will be accurate, current, complete, unique, or suitable for any particular purpose.
10. Ownership
- Carinfo.AI and its software, design, workflows, interfaces, databases, compilations, trademarks, logos, and other materials are owned by us or our licensors and are protected by intellectual property laws.
- Except for the limited right to use the service under these Terms, no rights are transferred to you.
- Feedback, suggestions, or ideas you provide may be used by us without restriction or compensation to you.
11. Fees And Paid Features
- If Carinfo.AI offers paid plans or paid features, the applicable prices, billing terms, renewal terms, and cancellation process will be presented at or before purchase.
- You authorize us or our payment processor to charge the payment method you provide for amounts due.
- Unless stated otherwise at purchase or required by law, fees are non-refundable. We will not use deceptive billing practices or make cancellation materially harder than signup.
12. Privacy
- Our Privacy Policy explains how we collect, use, disclose, and protect personal information.
- By using Carinfo.AI, you acknowledge that personal information will be handled as described in the Privacy Policy.
13. Suspension And Termination
- You may stop using the service at any time.
- We may suspend or terminate access if you violate these Terms, create legal or security risk, fail to pay amounts due, or use the service in a way that could harm us, users, third parties, or the service.
- After termination, provisions that by their nature should survive will survive, including ownership, disclaimers, limitations of liability, indemnity, dispute terms, and payment obligations.
14. Disclaimers
- The service is provided on an 'as is' and 'as available' basis.
- To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and security.
- We do not warrant that the service will be uninterrupted, error-free, secure, current, complete, or free from harmful components.
15. Limitation Of Liability
- To the maximum extent permitted by law, Carinfo.AI and its owners, officers, employees, contractors, agents, service providers, and licensors will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages, or for loss of data, goodwill, revenue, opportunity, vehicle value, or business.
- To the maximum extent permitted by law, our total liability for all claims relating to the service or these Terms will not exceed the greater of the amounts you paid to Carinfo.AI for the service in the three months before the event giving rise to the claim or one hundred U.S. dollars.
- Some jurisdictions do not allow certain exclusions or limitations, so some of the above limits may not apply to you.
16. Indemnity
- To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Carinfo.AI and its owners, officers, employees, contractors, agents, service providers, and licensors from claims, damages, losses, liabilities, costs, and expenses arising from your use of the service, your content, your violation of these Terms, your violation of law, or your infringement of third-party rights.
17. Governing Law And Disputes
- These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, unless applicable law requires otherwise.
- Before filing a claim, you agree to contact us and try to resolve the dispute informally. We will do the same when practical.
- Unless applicable law requires otherwise, disputes will be brought exclusively in the state or federal courts located in California, and you consent to personal jurisdiction and venue there.
18. Changes To These Terms
- We may update these Terms from time to time. If we make material changes, we will update the date above and provide notice when required by law or appropriate for the change.
- Your continued use of the service after updated Terms become effective means you accept the updated Terms.
- We will not retroactively change these Terms in a way that materially reduces your rights without legally appropriate notice or consent.
19. Miscellaneous
- These Terms, together with the Privacy Policy and any applicable order or plan terms, are the entire agreement between you and Carinfo.AI regarding the service.
- If any provision is found unenforceable, the remaining provisions will remain in effect.
- You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, reorganization, financing, sale of assets, or by operation of law.
- Our failure to enforce a provision is not a waiver of our right to enforce it later.
